I don't know if what Gap did was legal, but it cost me a job. I interviewed and afterwards received a call that I would be hired as long as I passed a drug test and background check. I took and passed the drug test and knowing that I did not have a criminal background assumed I would get the job. After not hearing back I decided to call when the rep advised me that my application had been denied due to a felony. I was shocked, because I do not have a felony. I told her that it wasn't right and asked if I could dispute. She had me contact sterling info systems, the provider of the background checks. Apparently this company does not search backgrounds using SSN, only name and DOB, as it is cheaper. I have a very common name. There is another person in the same county as me with my first and last name and DOB. We have different middle names. I was shocked that a company could do this. How many John Smith's out there with the same DOB? After my dispute went through I contacted GAP only to find out that the position had been filled. This was appalling and the most unfair practice I have been through in my life. I asked to be placed on a waiting list, but never heard back. I did find a different job, but I should not have to go through this.
